Personal Injury FAQs

Q: What is a personal injury?

A: A personal injury occurs when an individual is hurt due to malpractice, negligence, or someone else’s recklessness or inaction. Whether it’s physical or mental, a personal injury results from another person’s negligent or harmful actions. Personal injury can be result of the following:

  • Motor vehicle accidents
  • Medical malpractice
  • Animal attacks

  • Construction accidents
  • Workplace injuries

Q: How do I know if I can file a personal injury claim?

A: There are certain elements that are necessary when filing a personal injury claim. First and foremost, you must be able to demonstrate that you have suffered some sort of injury, whether physical or emotional. You must then be able to prove that your injury was caused by someone else’s negligence, recklessness or inaction. In fact, some cases require that you prove that said person was more at fault for your injury than you were.

Q: What if I was partly at fault for the accident?

A: Though it is still one of the most varying aspects of personal injury law, most states have laws that will give you rights to file a claim even if you were partially at fault. Texas law follows the doctrine of comparative responsibility, which allows a jury to assign the levels of liability in a lawsuit. In most cases, if you are found to be less than 60% responsible for your accident, then you are entitled to compensation. The payment you receive, though, will be proportional to your liability in the case, though.

Q: Will I automatically need an attorney?

A: If you have suffered a serious injury or are uncertain of what your injury can lead to, you may need to seek counsel from an experienced personal injury attorney. The sooner you do this the better, especially before signing any documents or releasing any information. Given that a high number of law firms offer a free initial consultation, you have nothing to lose by seeking an attorney. It is imperative that, when you decide to speak to an attorney, you do it within a reasonable amount of time. There is a statute of limitations that restricts the time you can wait before filing a lawsuit, otherwise you could be denied compensation. Hiring an attorney can help you stay within that time period, and help you receive the compensation you deserve.

Q: Isn’t it easier to just deal with the insurance company?

A: No. You need to understand that the insurance company has a team of attorneys and adjusters that are working against you. Their goal is to pay you as little as possible for your injuries. Never sign anything or give any statements to insurance companies without first consulting a personal injury attorney. You deserve fair compensation for your accident and all the consequences it has in your life. An experienced attorney in this matter will work in your best interest to help you recover physically, emotionally, and financially from your mishap.

Q: Is every personal injury lawsuit settled in court?

A: No. In fact, the majority of personal injury lawsuits are resolved out of court by the attorneys representing each side. If your case is indeed taken to court, it is very likely that you will have to give your testimony.

Q: How do I decide whether to accept a settlement or go to trial?

A: That decision is made after meeting with your attorney, based on the severity of your case. An experienced personal attorney will help you evaluate your options and present the best offers, so you can come to an agreement together that serves you and your family’s best interests.

Q: How long will my case take?

A: Believe it or not, most personal injury claims do not take a substantial amount of time unless they end up in trial. One you seek representation form a personal injury attorney, all matters are left at the firm’s hands. You will only have to worry about recovering from your injuries and receiving compensation for your suffering. If the case indeed goes to trial, then your time will be managed somewhat differently.

Q: If I win my case, how much money will I receive?

A: If you win your case, you will be entitled to a sum of money as compensation for you injuries and the suffering caused by the accident. The exact amount is hard to determine, because many factors must be taken into account. An experienced personal injury attorney will also help you make up for any financial losses caused by the accident (such as travel expenses, missed wages, private medical costs, etc).

Q: If I decide to make a personal injury claim, won’t I be hurting the person I am filing it against?

A: Many victims of personal injury have this concern, even though they clearly deserve compensation for their injuries. This shouldn’t be an issue, because these types of claims are handled by insurance company attorneys, and are paid by insurance. The defendant itself is not responsible for assuming any payments, so they are not being hurt by the personal injury claim.
